Ok so last night i was in a major debate with my fellow hunting buddy over deer tagging. Going into this next shotgun season we both still have 1 buck tag left, but as we play out scenarios we came across this subject and checked on the DNR website and it is rather misleading i thought….so maybe my fellow HO’ers can settle the score… In Illinois you are allowed to shoot 2 bucks a year.  If one of those bucks happens to be a button buck that you shot thinking it was a doe, or a spike with 3 inches or less of antler length, you can use an antlerless tag on it according to the DNR website. When you call it in you have an option to choose a buck with out antlers. Our debate was if you shoot an obvious buck and then you shoot another buck that is a button or 3in or less and use an antlerless tag and select buck with out antlers when you call it in, can you legally shoot another buck and use your either sex tag bringing your buck total to 3 for the year? We have not ran in to this issue because we have usually tagged out before 2nd season but this year we have not and there are a lot of hat racks and spikes running around and we dont want to be confused if this were to happen. We pride ourselves on being ethical hunters and would never want to be in a position where the rules were not followed correctly…i.e. would never want to risk doing something that would cause me to not be able to hunt in the future… Please enlighten…...

The way I see it, you are allowed two antlered deer.  Your button buck does not count as a legal buck.  For legal purposes, he is a doe.

agree.  If you can legally use a doe tag on it then it won’t count as one of your two bucks a year.  If you don’t want to use your E/S tag, there are still Doe permits available over the counter for most counties, except for the county I hunt in.

Two antlered deer (over 3 inches) are allowed. Notice it says antlered deer not antlered bucks. We had a situation with an antlered doe in our county and it was tagged incorrectly with a antlerless tag. It was later correctly taged.

I think too many hunters still think of their tags as “doe tags” or “buck tags.” (With the “buck tag” being flexible.) I do agree that the phone is system is confusing when it says “A buck with antlers or a buck without antlers.” Don’t let that bother you. It is their way of measuring how many button bucks are killed. It helps when they list the harvest ratio of male/female deer taken. Good Luck 2nd season to everyone.

So technically you can shoot more than 2 bucks a year if one of them falls into that catergory of button or 3in or less…thats what i thought but my hunting buddy is about 30 years older than me and told me you are allowed 2 bucks a year regardless of button or 3in rule…if you think about it, if you are drawn back on what you think is a doe and it turns out to be a button buck, its not really fair to the hunter to have that count towards his/her 2 buck a year limit. Now, i dont make it a habit of shooting button bucks or spikes or hat racks or anything, and most the time a spike or a hat rack is going to be above the 3in limit but never the less it could happen…Now all i need to do is write the IDNR and have them lay this out in black and white on their site!  this is what it currently say:
Bag Limit: One deer per legally authorized permit. All either-sex permits are
subject to the following restriction: no hunter, regardless of the quantity or type
of permits in his/her possession, may harvest more than 2 antlered deer during
a year, including the youth, archery, muzzleloader and firearm seasons. For
purposes of this bag limit, deer seasons are considered to be in the same year
if their opening dates fall within the same 12-month period that begins July 1.
A hunter in possession of an either-sex permit after having harvested 2
antlered deer during a year may only use the permit to harvest an antlerless
deer. Subject to this restriction, an either-sex permit holder is allowed to take
a deer with or without antlers during the legal season. An antlerless-only permit
holder is allowed to take only a deer without antlers or a deer having antlers
less than 3 inches long during the legal season.

I just spoke with a lady from the DNR NW region which i am in, and ran this by her, she said that with a button buck or a spike 3in or less can be tagged using your antlerless tag and that buck will NOT count towards your 2 bucks a year limit. So looks like we were all correct in our thinking. Thanks everyone!
